Check the Car Documentation
For a car to be gifted in Maryland, it must have been titled in Maryland. If it came from outside the state, it must have been titled in Maryland by the person intending to gift it. You must also be able to prove that any lien on the car has been released, which can be done with a Maryland security interest filing, or a letter signed by the lien holder.
Check the Qualifying Criteria
When it comes to gifting a car, the “family member” must be a member of your immediate family, such as spouse and parent.
Collect Your Documents
To gift a car, you will need to fill in an application for Maryland gift certification (VR-103) unless the car is gifted by an aunt or uncle, in which case you’ll need form VR-299. You should also have your certification of title, filled in so that the name of the giver is listed under “seller,” the name of the recipient is listed as “buyer,” and the price of the car is written as “gift.”
As well as these documents, you will also need:
- The odometer disclosure statement (VR-197)
- Proof of your family relationship
- A certificate of inspection
- The documents proving the release of a lien
The only exception is if the car is being gifted between spouses, or from a parent to a child. In this case, a certificate of inspection will not be needed.
Complete the Transaction
Once you’ve gathered your documents, take them down to the nearest MVA. You will also need:
- Your vehicle license
- Proof of insurance
- $100 for the titling fee
